Terms and Conditions of Business

1.                   If a vessel departs after a stowaway search has been conducted and a stowaway is then located prior to arrival at the vessels next port of call, the agent acting on behalf of the vessels owner should contact Stowaway Search Dogs immediately so that the most suitable method of repatriation can be assessed.

2.                   The indemnity granted is applicable only in respect of stowaways discovered after the said vessel has sailed from the port at which the search was carried out and prior to the docking at the said vessel’s next port of call.

3.                   No indemnity will be granted in respect of any stowaways detected during any search by Stowaway Search Dogs.

4.                   If a stowaway is located as mentioned above it is imperative that the details pertaining to the stowaway located is forwarded to Stowaway Search Dogs no later than 24 hours of the stowaway being located.

5.                   All stowaways found on board a vessel during a stowaway search prior to sailing will be handed over to the local South African Police Service for processing.

6.                   No indemnity shall be granted in respect of fines and or penalties.

7.                   Stowaway Search Dogs reserves the right to a) personally interview all stowaways found on a searched vessel;  b) personally handle stowaway repatriation if this is feasible for them to do so and c) retain all original documents found on a stowaway pending their repatriation.

8.                   Should Stowaway Search Dogs deem it inappropriate to handle the matter as mentioned in point 7 and the matter is handled by the owners P & I Club, the vessels owner can then lodge a claim with the company for re-imbursement of the repatriation fee once we have investigated and confirmed our liability pertaining thereto. To prevent inflated costs arising we require consultation between ourselves and any agent prior to finalising a settlement fee.

9.                   Our settlement will only cover costs relating to the repatriation of stowaways and not to incidental costs relating to the presence of the stowaway on a vessel.  Our cover will not exceed R 50 000 per claim.  All invoices pertaining to stowaway repatriation must be forwarded to Stowaway Search Dogs for scrutiny in order to determine if they were necessary and are quantifiable. Stowaway Search Dogs will pay the excess owing on Stowaway Search Dogs insurance.

10.                Our search will only be guaranteed in the above manner if the following conditions are adhered to:

10.1            Access must be given to all parts of the vessel including locked cabins/storerooms etc.

10.2            The master must provide all reasonable assistance during the search i.e. assisting with crewmembers to lock and unlock accesses etc.  Peculiarities of a particular vessel must be indicated to a search team during the search.

10.3            Stowaway Search Dogs will require no less than six hours notice prior to commencement of the search, unless special circumstances justify a short notice.  Such time will be indicated to the agent/master prior to commencing the search and made note of.

10.4            Stowaway Search Dogs will require reasonable time to conduct a stowaway search in order to guarantee same.  If the search time is insufficient this will be indicated to the master/agent for the purposes of non-implementation of the guarantee, and stipulated on service report.

11.                Should an area of a vessel prove to be inaccessible for any reason whatsoever i.e. due to the presence of poisonous gases, lack of air etc., the search will not be guaranteed.  Such an occurrence will be indicated on the service report once the search has been completed.

12.                The above conditions are to ensure that our service is in no way compromised and that all parties involved have their interests protected.

13.                Stowaway Search Dogs reserves the right to exclude a guarantee on certain vessels should they deem the risk to be unreasonable.  This will be timeously indicated to the vessels agent or owner prior to commencing the search.  Furthermore should the search then be cancelled our search team has been deployed, the contractee will be liable for a call out fee of 50% of the agreed search price.
